1. Agreement to Terms & Scope of Application
These Terms & Conditions ("Terms") constitute a legally binding agreement between you (the "Client", "Visitor", or "User") and Envision Design Studios ("the Studio", "we", "us", or "our"), founded and directed by Principal Architect Ar. Avi Mehta. By accessing our website (meetenvisionstudios.com), engaging our architectural consultancy services, submitting project briefs, or logging into the Envision StudioOS enterprise portal, you acknowledge having read, understood, and agreed to be bound by these Terms.
Individual architectural and interior projects are further governed by formal client consultancy agreements, stage-wise schedules, and sanctioned scopes of work executed between the parties.
2. Scope of Professional Architectural Consultancy
Envision Design Studios provides bespoke professional design, heritage conservation, and master planning consultancy across residential, commercial, institutional, and hospitality sectors. Standard consultancy typically proceeds in structured stages:
- Stage 1: Concept Development & Zoning: Site analysis, climate orientation, spatial zoning, preliminary master plans, and mood board directions.
- Stage 2: Schematic & Design Development: Volumetric 3D architectural massing, photorealistic interior/exterior renderings, preliminary structural coordination, and client review iterations.
- Stage 3: Good-For-Construction (GFC) & Working Drawings: Detailed architectural floor plans, sections, elevations, MEP (mechanical, electrical, plumbing) coordination drawings, and door/window schedules.
- Stage 4: Site Quality Review & Periodic Inspection: Periodic design clarification visits to ensure construction fidelity with design intent (excluding continuous civil contractor site supervision).
3. Intellectual Property Rights (Copyright Act, 1957)
Proprietary Intellectual Property
Under the provisions of the Indian Copyright Act, 1957, all architectural concepts, sketches, design layouts, 3D renderings, CAD drawings, site masterplans, elevations, and construction details authored by Envision Design Studios remain the exclusive intellectual property of Envision Design Studios and Ar. Avi Mehta.
Upon full settlement of professional consultancy fees for each corresponding milestone, the Client is granted a non-exclusive, non-transferable license to utilize the delivered drawings solely for the construction of the specific project at the designated site location. The Client shall not duplicate, sell, transfer, or reuse the drawings or concepts for any other property, building, or third-party project without the express prior written consent of Envision Design Studios.
4. Client Responsibilities & Statutory Approvals
To enable the timely and accurate execution of design consultancy, the Client undertakes and warrants:
- To provide authentic property ownership documentation, sanctioned revenue maps, and verified total-station topographical surveys.
- To commission certified geotechnical (soil test) investigations where structural design integration is required.
- To obtain all required statutory sanctions, environmental permissions, building permits, and municipal occupancy certificates through registered local liaison consultants.
- To provide written sign-off on drawings and milestone approvals within the stipulated project timelines to prevent site stoppage.
5. Professional Fees & Invoicing Terms
Professional fees are billed based on the executed consultancy agreement, either on a milestone stage basis or agreed percentage of construction value. All invoices issued by Envision Design Studios are subject to the following terms:
- Invoices are payable within 14 calendar days from the date of issue unless specified otherwise in writing.
- Payments must be remitted via authorized banking channels (NEFT / RTGS / IMPS) to the designated Envision Design Studios account.
- Statutory taxes, including Goods and Services Tax (GST), are levied in accordance with applicable Indian tax legislation.
- Work on subsequent project stages commences upon the receipt of settlement for the preceding milestone.
6. Professional Disclaimers & Limitations of Liability
Architectural and design consultancy is advisory in nature. While Envision Design Studios exercises the highest degree of professional care and skill in accordance with Council of Architecture (COA) standards:
- Contractor Execution: The Studio is not responsible for construction defects, substandard materials, or workmanship errors committed by the civil contractor, interior fabricators, or subcontractors engaged by the Client.
- Municipal & Regulatory Revisions: Building bylaws, municipal town-planning revisions, or delays by statutory authorities are beyond the control of the Studio.
- Maximum Liability: In any event, the total aggregate liability of Envision Design Studios arising out of any claim connected with this agreement shall not exceed the total professional fee actually received by the Studio for that specific project stage.
7. Envision StudioOS Portal Usage
Registered clients and authorized team members accessing the Envision StudioOS portal agree to maintain strict confidentiality of their access credentials. Unauthorized scraping, automated data harvesting, or reverse-engineering of the StudioOS interface, financial engines, or relationship mindmaps is strictly prohibited.
8. Dispute Resolution & Governing Jurisdiction
In the event of any dispute or difference arising out of or in connection with these Terms or any project consultancy agreement:
- The parties shall first endeavor to resolve the dispute amicably through good-faith mutual discussions between the Client and Ar. Avi Mehta.
- Failing amicable resolution within 30 days, the dispute shall be referred to sole arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Pune, Maharashtra, India, and the proceedings shall be conducted in English.
- These Terms shall be governed by and construed in accordance with the laws of India. Subject to arbitration, the courts of competent jurisdiction at Pune, Maharashtra shall have exclusive jurisdiction.
